Terms & Conditions

ProHVACTek (the "Platform," "we," "us") is an online community and toolset for heating, ventilation, air-conditioning and refrigeration ("HVAC/R") professionals. These Terms & Conditions ("Terms") form a legally binding agreement between you and the operator of ProHVACTek. Our Privacy Policy is incorporated into these Terms by reference.

The Platform is offered solely to persons who are at least 18 years old and who work in, train for, or are otherwise qualified in the HVAC/R trade. At sign-up you must affirm that you are an HVAC professional. That affirmation is a condition of access; if it is untrue, your licence to use the Platform is void and we may terminate your account immediately.

The Platform is not intended for consumers, homeowners performing DIY work, or children. Nothing here should be relied on by a member of the public.

All content on the Platform is provided for general reference and peer discussion only. This includes manuals, model data, AI-generated answers, troubleshooting flows, calculators (including the nitrogen and pressure-temperature tools), education videos, chat messages, posts, and any other output.

We do not provide engineering, safety, legal, refrigerant-handling, electrical, or code-compliance advice, and no professional relationship is created by your use of the Platform. You remain solely responsible for verifying every value, procedure and specification against current manufacturer documentation, applicable codes and standards, your employer's policies, EPA and other regulatory requirements, and your own licensed judgment before acting.

HVAC/R work involves pressurised gases, high voltage, combustion, refrigerants, chemicals and heavy equipment, and can cause serious injury, death, or property damage. You assume all risk arising from any decision you make while using or after using the Platform.

Some features use automated systems and large language models, including image/nameplate recognition and manual question answering. AI output may be incomplete, outdated, or factually wrong ("hallucinated"). It is not reviewed by a human before you see it. Treat every AI response as an unverified starting point, never as an instruction.

You must provide accurate registration information, keep your credentials confidential, and are responsible for all activity under your account. Tell us at info@prohvactek.com immediately if you suspect unauthorised use. We may suspend, block, or delete any account at any time, with or without notice, for any reason permitted by law, including suspected violation of these Terms.

You agree not to:

• post unlawful, defamatory, harassing, hateful, threatening, or obscene content;
• upload material you do not have the right to share, including copyrighted manuals or documents you are not licensed to distribute;
• upload malware, or attempt to probe, scan, overload, or breach the Platform;
• scrape, mine, or bulk-export content, or use it to train competing models;
• impersonate any person, or misrepresent your trade credentials;
• post other people's personal information without their consent;
• use the Platform for any purpose that is unlawful in your jurisdiction.

We may remove content, restrict messaging, mute, ban temporarily or permanently, or terminate accounts at our sole discretion. Moderation decisions are made on a best-efforts basis; we are not obliged to monitor content and do not guarantee that objectionable content will be found or removed.

You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt, display and distribute that content for the purpose of operating, securing, and improving the Platform. You represent and warrant that you have all rights necessary to grant this licence and that your content does not infringe any third-party right.

Manuals and documents you upload are reviewed before publication. We may decline, remove, or delete any submission for any reason. Do not upload confidential customer data.

We respect intellectual property rights. If you believe material on the Platform infringes your copyright, email info@prohvactek.com with: identification of the work, the URL or location of the material, your contact details, a statement that you have a good-faith belief the use is unauthorised, a statement under penalty of perjury that your notice is accurate and that you are authorised to act, and your signature. We will remove or disable access to material that is the subject of a valid notice and may terminate repeat infringers.

The Platform links to and integrates with third-party services (for example ManualsLib, YouTube, email providers, and cloud infrastructure). We do not control and are not responsible for third-party content, availability, accuracy, or privacy practices. Your use of those services is governed by their own terms.

Where you invite technicians to your team or accept such an invitation, you are responsible for the permissions you grant and for the lawfulness of any customer, site, or job data you share. If you upload information about third parties (for example customer names, addresses, or phone numbers), you confirm you have a lawful basis to do so and you act as the controller of that data.

Access is currently free. We may introduce paid features in the future; any charges will be disclosed before you incur them and will not apply retroactively.

The Platform is provided on an as-available basis. We may modify, suspend or discontinue any feature at any time, and we do not guarantee uptime, data retention, or that any content will remain accessible. Keep your own copies of anything you need.

To the fullest extent permitted by law, the platform and all content are provided "as is" and "as available," without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, or non-infringement. We do not warrant that any content, manual, calculation, measurement, AI answer, or user statement is correct, current, complete, or safe to act upon.

To the fullest extent permitted by law, we and our owners, officers, employees, contractors and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, business, or for personal injury, death, or property damage, arising out of or relating to your use of or inability to use the platform, however caused and on any theory of liability, even if advised of the possibility of such damages.

Our total aggregate liability for all claims relating to the platform will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose or (b) one hundred US dollars (US$100).

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you; in that case our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify and hold us harmless from any claim, demand, loss, liability, damages, fine, cost or expense (including reasonable legal fees) arising out of or related to your content, your use of the Platform, your work performed in the field, your breach of these Terms, or your violation of any law or third-party right.

We would rather solve problems directly. Before filing anything, email info@prohvactek.com and give us 30 days to resolve the dispute informally.

If we cannot resolve it, you and we agree that any dispute arising out of or relating to these Terms or the Platform will be resolved by final and binding individual arbitration, administered by a recognised arbitration provider under its consumer or commercial rules, in the English language, in the State of New York, USA, or by video conference. The arbitrator decides all issues, except that either party may bring an individual claim in small-claims court.

You and we waive any right to a jury trial and any right to participate in a class, collective, consolidated or representative action. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing info@prohvactek.com with the subject line "Arbitration Opt Out" and your account email. Opting out does not affect any other part of these Terms.

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules. Where arbitration does not apply, the state and federal courts located in New York have exclusive jurisdiction, and you consent to that venue.

Any claim relating to the Platform must be brought within one (1) year after it arises, or it is permanently barred, to the extent permitted by law.

We may update these Terms. Material changes will be posted here with a new effective date and, where practical, notified by email or in-app notice. Continued use after the effective date means you accept the updated Terms.

If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, with the Privacy Policy, are the entire agreement between us.
